JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Abadpur P.S.Case No. 70 of 2017 registered under Sections 272, 273 of the Indian Penal Code and 30(a) of Bihar Prohibition Excise Act, 2016.
The allegation is that on secret information received, the police raided the spot and recovered illicit wine from a bamboo orchard where one person was standing .The aforesaid person is said to be the petitioner.
Learned counsel for the petitioner submits that no recovery has been made from the possession of the petitioner. The petitioner is innocent and is in custody since 26.04.2017 and has clean antecedent.
Patna High Court Cr.Misc. No.27061 of 2017 (2) dt.14-06-2017 2/2 Having regard to the facts and circumstances of the case I deem it fit and appropriate to enlarge the petitioner on bail. Accordingly, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II cum Special Judge, Katihar in connection with Abadpur P.S.Case No. 70 of 2017.
