The petitioner seeks bail in connection with Roh P.S. Case No. 28 of 2017 registered for the offences under Sections 30(a) of the Bihar Prohibition Excise Act, 2016. As per prosecution case, 360 lts. spicy liquor is said to have been recovered from the possession of the petitioner and one co-accused Saurabh Kumar sitting in a car.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence and he has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner. Neither the said wine was recovered from the car nor

Co-accused Saurabh Kumar has been enlarged on bail by this Court vide order dated 07.06.2017 passed in Cr. Misc. No. 25389 of 2017. The petitioner is languishing in jail custody since 23.03.2017. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.
