The petitioners are apprehending their arrest in connection with Complaint Case No. 303/2015 for the offences instituted under Sections 406, 420, 467 and 468/34 of the IPC. The prosecution story, in brief, is that the complainant had purchased 16 decimal of land of Plot No. 526/316, Khata No. 70/46 in the name of his wife Jitani Devi from accused Bhushan Sao but Bhushan Sao again executed Sale Deed No. 4489 on 02.07.2015 in respect to the same land in the name of Savitri Devi

Patna High Court Cr.Misc. No.11230 of 2016 (2) dt.25-04-2016 2/2 and this fact has come to the knowledge of the complainant on 28.07.2015.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The matter relates to sale and purchase of the land. The same is of civil nature. On behalf of the State it has been submitted that the petitioners are named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 303/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
