JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in connection with Lakhisarai P.S. Case No. 35 of 2011, pending before learned Chief Judicial Magistrate, Lakhisarai, registered for the offences punishable under Sections 419 and 420/34 of the Indian Penal Code.

I refused to entertain this anticipatory bail application on the sole ground that the petitioner approached the Court for grant of anticipatory bail belatedly. Lakhisarai P.S. Case No. 35 of 2011 was lodged on 01.02.2011. For the first time, the petitioner approached the Court of learned Sessions Judge, Lakhisarai in the year 2014.

Patna High Court Cr.Misc. No.3035 of 2015 (3) dt.14-05-2015 2/2 Learned counsel for the petitioner has attempted to refer certain orders passed by this Court, whereby, other coaccused persons have been granted bail/anticipatory bail. The Court had granted them bail in the year 2011. This application is, accordingly, rejected.

The petitioner is directed to surrender before the court below within a period of six weeks from today. If he does so and seek regular bail, the same shall be considered on its own merit without being prejudiced by rejection of present anticipatory bail application.
