JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Atari P.S. Case No. 240 of 2013 registered for the offences punishable under Sections 406, 409, 420 and 120B of the Indian Penal Code.

Admittedly, petitioner was Panchayat Secretary at the relevant time and he along with Mukhiya handled the bank account but it is also an admitted position that the concerned work was allotted in the year 2006 and the enquiry was done in the year 2013 i.e. after seven years of the allotment of the concerned work. Moreover, having got more or less similar allegation, some coaccused persons including Mukhiya of Sahora Panchayat have already been admitted to anticipatory bail by different Benches of

Patna High Court Cr.Misc. No.1283 of 2015 (2) dt.13-01-2015 this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Atari P.S. Case No. 240 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
