JUSTICE ARUN KUMAR ORAL ORDER 16-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sessions Trial No. 29 of 2017 arising out of Shahpur P.S.Case No. 63 of 2013 registered under Sections 302, 307 and 120B of the Indian penal Code and Section 27 of Arms Act. Allegation in brief is that petitioner along with other accused persons intercepted deceased and made indiscriminate firing from LMG gun causing his death instantly. The motive assigned is that they were putting pressure not to give evidence in another case of murder.
Submission is that due to enmity, petitioner has falsely been implicated in this case and on that very date, he was sentenced in a case by the court of Kolkata.
Whereas learned counsel for the State submits that there is
Patna High Court Cr.Misc. No.10023 of 2018 (3) dt.16-03-2018 2/2 specific allegation against the petitioner and has a large number of criminal antecedents and he was also declared absconder. Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner, at present, is rejected. As submission was advanced that case has been committed to the court of Sessions, so trial court is directed to expedite the trial. (Arun Kumar, J) Sujit/- U T
