Petitioner seeks bail in Dhamdaha P.S. Case No.247 of 2018 instituted for the offence under Section(s) 25(1-b)A, 26, 35 of the Arms Act.
Counsel for the petitioner submits that petitioner has clean antecedents. It is alleged in the written report that the gun belongs to Viveka Singh. In the seizure list, there is signature of wife of the petitioner. Petitioner was not present on the spot at the time of alleged recovery.
Petitioner is in custody since 18.12.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of
Patna High Court CR. MISC. No.14146 of 2019(2) dt.07-03-2019 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No.247 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
