The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
As per the prosecution case, it is alleged that on the persuasion of this petitioner, informant brought his wife to the clinic of Dr. Yogendra Kumar who was suffering from cough and cold where she was operated and after some time she died. It is submitted that petitioner never advised the informant to go to Dr. Yogendra Kumar for treatment of his wife rather the informant himself carried his wife to the clinic of Dr. Yogendra and Dr. Yogendra Kumar operated the wife of
Patna High Court CR. MISC. No.15228 of 2023(2) dt.18-05-2023 2/2 informant. The only allegation against this petitioner is that he persuaded the informant. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Rosera, Samastipur in connection with Hasanpur P.S.
