2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Shahpur P.S. Case No. 80 of 2024 instituted for the offence under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(5) and 61(B) of the B.N.S. and Sections 66(B), 66(C) and 66(D) of the Information Technology Act.

3. The case of the prosecution is that the informant has received a secret information that 10 persons named in the F.I.R. are indulged in cheating the common persons. On this information, S.I.T. was constituted. As the informant reached near the orchard of Daya Singh, he found that 10 persons started

Patna High Court CR. MISC. No.15540 of 2025(2) dt.05-03-2025 2/3 fleeing away. Three persons were apprehended. They are Amit Kumar, Prince Kumar and Shivam Kumar. These persons have disclosed the name of this petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He is having criminal antecedent of two cases out of which, one is of similar nature. It has also been submitted that due to same nature of case, he has been implicated. There is no material against the petitioner. It has also been submitted that co-accused has been granted anticipatory bail by this Court vide order dated 21.02.2025 in Cr. Misc. No. 10257 of 2025.

5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Shahpur P.S. Case No. 80 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
