JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner seeks regular bail in Dawath P.S. Case No.34 of 2017 registered for the alleged offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 475 pouches each of 200 ml of country made liquor was seized from the Beloro vehicle and accused Ritu Ranjan Yadav was apprehended by the police while the two accused persons managed to escape. The apprehended accused person disclosed the name of the petitioner as one of his accomplice.

It has been submitted by learned counsel for the petitioner that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner was not apprehended on the spot by the police rather he has been named in

Patna High Court Cr.Misc. No.26372 of 2017 (02) dt.12-06-2017 - 2 - this case by the apprehended accused Ritu Ranjan Yadav. Nothing incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has been languishing in custody since 25.03.2017.

Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Bikramganj in Dawath P.S.
