01-07-2020 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel for the informant through video conferencing.
The petitioner apprehends his arrest in Manjhagarh P.S. Case No. 215 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per First Information Report, the allegation against the petitioner is that he inflicted sword blow on the head of mother of the informant.
It is submitted on behalf of petitioner that there is case and counter case between the parties and the case filed from the petitioner's side is earlier point of time. Due to land dispute, a scuffle took place between the parties and both sides sustained injury. It is further submitted that all the injuries caused to

However, learned counsel for the informant vehemently opposed the prayer for bail and submitted that there is specific allegation of overt act against the petitioner. Considering the aforesaid facts and circumstances, the anticipatory bail application is allowed.
In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 215 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay U T
