The petitioner seeks bail in S.Tr. No. 840/2018, arising out of Parsa P.S. Case No. 97/2017, instituted for offences under Section(s) 147, 148, 149, 307, 302 and 326 of the Indian Penal Code.
Petitioner is in custody since 21.06.2017.
Earlier prayer for bail of petitioner was twice rejected by a Co-ordinate Bench of this Court vide orders dated 18.01.2018 passed in Cr. Misc. No. 56865/2017 and dated 18.07.2018 passed in Cr. Misc. No. 35183/2018.
In the written report, there is specific allegation against this petitioner of assaulting the husband of informant with Bhala, who died on the spot sustaining injury.
Report from the court below regarding present stage of
Patna High Court CR. MISC. No.13376 of 2019(3) dt.28-05-2019 2/2 case has been received wherein it is mentioned that charge has not been framed in this case.
Considering the fact that there is direct allegation against this petitioner, this Court is not inclined to grant bail to the petitioner.
Accordingly, prayer for bail of petitioner is again rejected.
The trial court is directed to frame charge in this case within fifteen days from the date of receipt/production of copy of this order and proceed in trial either on day to day basis or by giving short adjournment.
The trial court shall make all efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of this order. The District & Sessions Judge, Saran at Chapra is directed to monitor the trial of this case and send compliance report.
