Mr.Abhay Kumar Roy, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-09-2020 Heard Ms. Bela Singh, the learned counsel for the petitioner and Sri Abhay Kumar Roy, the learned APP for the State.

This is an application for grant of anticipatory bail in connection with Ahiyarpur P.S. Case No. 975 of 2019 registered for the offence punishable under Sections 447, 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having assaulted the son of the informant as also other persons resulting in injuries being inflicted upon the injured persons.

Patna High Court CR. MISC. No.14135 of 2020(3) dt.10-09-2020 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the present case arises out of case and counter case.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available in the case diary as also the fact that specific and direct allegation of assault has been levelled upon the petitioner herein, which has resulted in the injured sustaining injuries, I do not find any merit in the present petition, hence, the same stands dismissed.
