The petitioner, who is in custody since 24.01.2019, seeks bail in connection with Tariyani P. S. Case No. 194 of 2018 dated 05.12.2018 instituted for the offences under Sections 379, 414 and 34 of the Indian Penal Code.

The motorcycle of the informant was stolen.

The petitioner has been falsely implicated in this case as the stolen motorcycle was sold to him without any information regarding the same being stolen by one Dadan Ram at a price of Rs. 11,000/-. The purchase of

Patna High Court CR. MISC. No.16589 of 2020(2) dt.02-06-2020 2/2 the stolen motorcycle was made on 16.12.2018. The petitioner had no idea that the motorcycle purchased by him was a stolen property.

It has been urged that the petitioner has been made victim of the circumstances.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned I/C Chief Judicial Magistrate, Sheohar in connection with Tariyani P. S. Case No. 194 of 2018.
