JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Parbatta (Maraiya) PS Case No. 362 of 2017 registered under Sections 392 and 120B of the IPC.

The allegation in brief is that one Suman Kumar driver of the pick up van gave assurance to the traders to help them in purchasing banana in lower price and the petitioner was also in the pick up van along with him but on the way the traders were looted by the miscreants as they were called by the driver and the petitioner. Learned Counsel for the petitioner submits that Suman Kumar, named accused in the FIR, has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 6809 of 2018 and only on his disclosure in the confessional statement the petitioner was made accused.

Having considered the said facts and circumstances, the petitioner, namely, Tinku Kumar Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Khagaria in connection with Parbatta (Maraiya) PS Case No. 362 of 2017.
