JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 The petitioner seeks regular bail in connection with Piri Bazar P.S. Case No. 82 of 2016, registered for offences punishable under Section 366(A) of the Indian Penal Code. Allegation against the petitioner that he along with one other person kidnapped the sister of the informant. It has been submitted on behalf of the petitioner that no offence as alleged has taken place and the girl has gone out with the petitioner out of her own sweet will, which is evident from her statement recorded under Section 164 Cr.P.C. in which she has stated that she still wants to live with the petitioner. Petitioner has been in judicial custody since 01.11.2016.

Having heard both sides, considering the facts and circumstances of the case and also considering the statement of the girl recorded under Section 164 Cr.P.C., let the petitioner above
