This application, for grant of anticipatory bail, arises out of Mahila (Saran) Police Station Case No. 30 of 2018, disclosing offences under Sections 341, 323, 498A and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act, 1961.
There is allegation against the petitioner that he established physical relationship with the informant on assurance of marriage and subsequently, solemnised marriage in a temple.
Learned Counsel appearing on behalf of the
Patna High Court CR. MISC. No.13513 of 2019(2) dt.06-03-2019 2/2 petitioner, in my view, is correct in her submission that the allegation of demand of dowry is not against this petitioner and allegation is quite vague.
Considering the above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Saran at Chapra, in connection with Mahila (Saran), Police Station Case No. 30 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
