2. The petitioners are apprehending their arrest in a case in connection with Athmalgola P.S. Case No. 259 of 2023 dated 23.08.2023 registered for the offence/s punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, five unknown miscreants boarded on two motorcycles stopped the vehicle of the informant and snatched Rs. 4,000/-, mobile phone, golden chain and other documents i.e. pan card, voter card, Aadhar card etc.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been

The name of the petitioners has sprung up in the confessional statement of the co-accused Bablu Kumar and Raj Kumar. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Barh, Patna in connection with Athmalgola P.S. Case No. 259 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
