The petitioner is apprehensive regarding his arrest relating to Pratapganj P. S. Case No. 22/2015 registered under Sections 420, 467, 468, 471, 120 (B) of the I.P.C. Learned counsel for the petitioner submits that the petitioner along with others has been alleged to have submitted forged BETET (Teacher Eligibility Test) Certificate in an order of Procure service of teacher. Learned counsel for the petitioner also submits that as appointment has not been done, therefore, none of the offences whereunder the case has been registered, is made out. It has also been submitted that in similar way Pratapganj P.S.Case No. 15/15 has been registered against the petitioner and
Patna High Court Cr.Misc. No.12340 of 2016 (2) dt.28-03-2016 2/2 others wherein he is availing anticipatory bail. So submitted that, in the facts and circumstances of the case the petitioner be released on an anticipatory bail. The learned A.P.P. Opposes the prayer for anticipatory bail.
Taking into account the allegation, coupled with the fact as disclosed by the learned counsel for the petitioner that the petitioner has not succeeded in procuring job, happens to be good ground for seeking regular bail, which the learned lower Court will consider whenever, so prayed on behalf of the petitioner With the aforesaid observation, the instant petition is disposed of.
