The petitioner is accused in connection with Sessions Trial No. 315 of 2017 arising out of Jadopur P.S. Case No. 50 of 2012 registered under sections 307, 387, 302/34 of the I.P.C. and section 27 of the Arms Act pending in the Court of A.D.J.-VIII, Gopalganj.
Earlier, prayer of the petitioner for bail was rejected twice by this Court vide Cr. Misc. No. 44230 of 2014 and Cr. Misc. No. 28191 of 2016 on 04.03.2015 and 13.02.2017 respectively.
Submission of learned counsel for the petitioner is that petitioner is in custody since 18.01.2014.
Patna High Court Cr.Misc. No.9147 of 2018 (3) dt.04-04-2018 2/2 The report of the learned Additional District and Sessions Judge-VIII, Gopalganj shows that the charge has already been framed and the record is still pending for evidence of other witnesses.
Having considered the above facts and circumstances of the case and criminal antecedent of the petitioner, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, trial Court is directed to conclude the trial within a period of six months from today.
