The appellant seeks bail in Hussainganj P.S. Case No.13 of 2020, registered under Sections 341, 323, 447, 448, 354, 504 and 506 of the Indian Penal Code and under Sections 3(i) (r)/3 (2)(iv) of the SC/ST Act.

The informant, who is a B.D.O., Hussainganj, alleged that the appellant called him on phone 4-5 days regularly. The appellant being a Panchayat Executive Assistant was apprehending his transfer but the appellant started exerting pressure on the informant. On 19.01.2020, while the informant was all alone in her house along with her daughter, the appellant entered into her house, abused the informant by naming her caste and also threatened her for dire consequences.

Patna High Court CR. APP (SJ) No.796 of 2020(3) dt.01-06-2020 2/2 Learned counsel for the appellant submits that the appellant is innocent and he has in fact committed no offence. Some altercation took place for which the informant lodged the present case making false and frivolous allegations. Taking into consideration the facts and the nature of allegations made against the appellant and the fact that the appellant is in jail since 21.01.2020, appellant, namely, Kumar Chitransh is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge-cum-Special Judge, Siwan in connection with Hussainganj P.S. Case No.13 of 2020. The appeal is accordingly allowed.
