JUSTICE GOPAL PRASAD ORAL ORDER 09-03-2016 The present application has been filed for modification of the order dated 14.01.2015 passed in Cr. Misc. No. 46375 of 2014 to the extent that the conditions mentioned in the order dated 14.01.2015 may be deleted because the complainant has already died prior to passing of the aforesaid order.
From the records, it appears that the petitioner was granted provisional bail for four months with conditions that after one month of his release, the petitioner shall keep his wife with full dignity or if for any reason the wife is not ready to live with him, the petitioner shall pay maintenance worth Rs.2,000/- per month till a higher maintenance is decided by a competent court and after four months the court below on being satisfied that the petitioner is fulfilling the conditions shall confirm the bail bond and the petitioner shall appear in person in court on
Patna High Court Cr.Misc. No.11593 of 2016 (2) dt.09-03-2016 each and every date fixed in the case and any absence on two consecutive dates without any reasonable ground to the satisfaction of the court below shall be a ground of cancellation of bail of the petitioner by the lower court itself. It is submitted by the learned counsel for the petitioner that prior to passing of order dated 14.01.2015 the complainant has already died on 01.06.2014. The death certificate has been brought on record as Annexure-2. Hence, the order dated 14.01.2015 is modified to the extent that the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds and on being satisfied that the petitioner is fulfilling the conditions, the court below shall confirm the provisional bail of the petitioner and if the petitioner shall be absent on two consecutive dates which will itself be a ground for cancellation of the bail bond of the petitioner.
