The petitioner seeks bail in Maner P.S. Case No. 562 of 2016 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

25.500 litres of foreign liquor is said to have been recovered from the motorcycle of Pappu Kumar lying abandoned in the Mango orchard.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has neither any concern with the seized motorcycle nor with the seized liquor. Though two more criminal cases have been lodged against the

Patna High Court Cr.Misc. No.16173 of 2018 (2) dt.21-03-2018 2/2 petitioner, but he is on bail in the aforesaid cases. He has been languishing in custody since 05.01.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Maner P.S. Case No. 562 of 2016.
