The petitioner is a holder of a license bearing License No. 16 of 2007 for running a fair price shop under the Public Distribution System (Control) Order, 2001 read with the Bihar Fair Price Shop Order, 2007.

The license of the petitioner was cancelled under the order of the licensing authority-cum-Sub Divisional Officer, Danapur, District-Patna vide order passed on 24.8.2013. Being aggrieved the petitioner has preferred an appeal before the

Patna High Court CWJC No.423 of 2015 (2) dt.18-02-2015 statutory authority i.e. the District Magistrate, Patna giving rise to E.C. Appeal No. 38 of 2013 and which has remained pending. Hence this writ petition.

Having heard learned counsel for the parties and taking note of the limited grievance raised herein, the writ petition is disposed of with a direction to the District Magistrate, Patna to consider and dispose of E.C. Appeal No. 38 of 2013 in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within three months from the date of receipt / production of a copy of this order.
