ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner No.2 Jitendra Raut is apprehending his arrest in connection with Giriak (Katrisarai) P.S. Case No.291 of 2015 for allegedly having committed the offence under Sections 341, 323, 325, 307, 337 and 504/34 of the Indian Penal Code.
It appears from perusal of the F.I.R. that the allegation against petitioner no.2 is that he had given injury on the hip of the informant. The Doctor has opined the same to be simple in nature.
Learned counsel for the petitioner submits that there
Patna High Court Cr.Misc. No.10377 of 2016 (3) dt.10-05-2016 2/2 is a case and counter case between the parties. The petitioner has also lodged Giriak P.S. Case No.292 of 2015. Considering the nature of allegations and the injury report as well as the fact that the petitioner No.2 is not having any criminal antecedents, let Petitioner No.2, namely, Jitendra Raut, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sushil Prasad, J.M. 1st Class, Biharsharif, Nalanda, in connection with Giriak (Katrisarai) P.S. Case No.291 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
