JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 The petitioner seeks regular bail in connection with Bounsi P.S. Case No. 49 of 2017, registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of ten litres for foreign liquor.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, petitioner has sufficiently been punished for the said offence as he has been in judicial custody since 19.03.2017.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, quantity of liquor recovered and also
Patna High Court Cr.Misc. No.26554 of 2017 (3) dt.21-06-2017 2/2 that petitioner has no criminal antecedent and has remained in custody for three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka, in connection with Bounsi P.S. Case No. 49 of 2017. It is also made clear that if the petitioner again found involved in any of such offence, in future, his bail bonds will be cancelled.
