JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Hawai Adda PS Case No. 2 of 2015 registered under Sections 341, 323, 307, 406, 420, 379/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the petitioner put a proposal to the informant to purchase a piece of land in Delhi and total consideration money was 76 lakh 50 thousand rupees and the said amount was given by cash, draft and cheque but even after persuasion for long period neither sale deed was executed nor consideration money was returned, panchayati was held and 35 lakh 50 thousand rupees was returned and rest money is still due. Learned Counsel for the petitioner submits that there was only oral agreement in the year 2008, the petitioner was given 30 lakh forty thousand rupees and rest amount was to be paid but he never paid and therefore sale deed was not executed but later on after panchayati9 he paid 35 lakh including interest.
