Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner seeks anticipatory bail in connection with Banka P.S. Case No. 748 of 2020, registered for the offence under Sections 406 & 420 of the Indian Penal Code. Learned counsel for the petitioner and learned counsel for the opposite party no. 2 jointly submit that the matter has been settled.
In view of the above this application for anticipatory bail is allowed.
Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the court
Patna High Court CR. MISC. No.24226 of 2021(7) dt.13-04-2022 2/2 below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 748 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
At the time of accepting the bail bond in the Court below the learned Magistrate will verify the fact of the compromise from the informant. If the compromise is found accepted by the informant then the bail bond shall be accepted. If the compromise is denied by the informant then the petitioner shall be arrested.
