JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 384 of the Indian Penal Code.

Prosecution case is that as per the audio clip of one Bipin Paswan, petitioner demanded bribe of Rs. 2 lacs for selection of his wife Nibha Kumari on the post of Sevika. Learned counsel for the petitioner submits that the petitioner is a lady supervisor and has falsely been implicated in this case. It is further submitted that the name of said Nibha Kumari was running at serial no.2 of the merit list and there was only one vacancy, as such there was no occasion for demanding bribe for her appointment. It is further submitted that the instant case has been lodged to pressurize the petitioner to ensure appointment of NibhaKumari. Petitioner

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Bhagwanpur Police Station Case No. 28 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
