Petitioner seeks bail in a case registered for the offence punishable under Sections 420,467,468,471,120(B) of Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition & Excise Act, 2016.

Allegation is recovery of 2691 litres of foreign liquor from a truck which was being driven by the petitioner. It has been submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 12.12.2020.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.23877 of 2021(3) dt.23-06-2021 2/2 and also the fact there is huge recovery of foreign liquor from the truck which was being driven by the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected. However, since petitioner has no criminal antecedent, he may renew his prayer for bail after one year of custody.
