The petitioners seek regular bail in connection with Sultanganj P.S. Case No. 225 of 2016, registered under Sections 307 and 34 of the Indian Penal Code.
The allegation leveled against the petitioners is with regard to the petitioners and others forming an unlawful assembly with deadly weapons and restraining the informant and others. It has been further alleged that the accused namely Kanbuchha Yadav fired at the informant resulting in injury to the informant. It has also been alleged that one accused named Vinit Yadav has fired on the Bolero vehicle of the informant. Learned counsel for the petitioners submits that so far
Patna High Court Cr.Misc. No.27065 of 2017 (2) dt.15-06-2017 2/2 as petitioners are concerned, there is no specific allegation of over act against them and have been falsely implicated. They are said to be the members of unlawful assembly. They have no criminal antecedent and are in custody since 12.04.2017. Having regard to the facts and circumstances of the case, petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in connection with Sultanganj P.S. Case No. 225 of 2016.
