The petitioners seek bail in anticipation of their arrest in connection with Kankarbagh P. S. Case No. 605 of 2020, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation of the petitioners is on the basis of confession of one of the arrested accused persons of this case.

Patna High Court CR. MISC. No.23963 of 2021(2) dt.13-01-2022 2/2 However, regard being had to the fact that the petitioners were earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to them.

The prayer for anticipatory bail is rejected. However, if the petitioners surrender before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on their behalf has not been entertained by this Court.
