JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-06-2017 Heard Sri Pranaya Shanker Sinha, learned counsel for the petitioner and Sri Bharat Lal, learned A.P.P. for the State. The petitioner in the present case is seeking regular bail in connection with Shastrinagar P.S. Case No. 519 of 2015 for offence registered under Section 304(B)/34 of Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 20.03.2016 and there is a compromise between the parties, as contained in Annexure-03. Learned counsel further submits that despite of several dates fixed in the matter, the charges have not been framed and the petitioner is languishing in jail without their being any progress in the trial.

In the facts and circumstances of the case, this Court is of the opinion that instead of granting bail to the petitioner at this stage, the trial Court is directed to pass appropriate order for framing of

Patna High Court Cr.Misc. No.25951 of 2017 (2) dt.15-06-2017 2/2 charge within a period of one month from the date of receipt of this order and, thereafter, the case shall proceed on day to day basis so as to reach logical conclusion, preferably, within a period of six months from the date of framing of charge.

The application is disposed of with the aforesaid direction.
