The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of I.P.C. and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 48 litres Nepali Saufi wine was recovered from the fruit shop of the other co-accused, namely, Manjan Paswan and Pramod Paswan. It is further contended that petitioner was not apprehended from the spot and the fruit shop also does not belong to the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 18.03.2018.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.22956 of 2018(2) dt.19-04-2018 2/2 the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. II-cum-Special Judge Excise Act Sitamarhi in connection with Riga P.S. Case No. 253/17. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
