Petitioner was a candidate for selection of constable under advertisement no.1/2014. He was declared selected and directed to report for joining. After verification of the certificates, he was appointed on probationary sipahi. Office received letter from Central Selection Board of constables that two of selected candidates including petitioner be directed to submit their documents.

Issue, whether petitioner had himself participated in the Selection Board or someone else appeared in his place, was enquired by the Superintendent of Police, Bhojpur. The order

Patna High Court CWJC No.4201 of 2016(2) dt.09-05-2019 2/2 dated 09.10.2015 issued by the Officer on special duty in Central Selection Board clearly recorded that the petitioner had appeared and given confessional statement that one person whose name he had disclosed, appeared in written examination on his behalf on payment of Rs 3,50,000/- and thereafter, he became successful in selection process. In view of specific admission made by the petitioner, he has been removed from service and Ara Nawada P.S. case no. 379/2015 for the offences under sections 419,420, 467, 468, 471,120B IPC and 3⁄4 of Bihar Examination Act was registered against petitioner and others. In view of admitted position emerging from the counter affidavit, this court would consider it appropriate not to interfere in the matter.

Writ petition is dismissed.
