The petitioner has preferred this application for grant of regular bail in a case registered under sections 394 and 397 of the Indian Penal Code.
As per the prosecution case, three accused persons are stated to have committed robbery. In commission of the offence it is stated that one of the accused fired from his pistol injuring the driver of the vehicle in his head.
It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation. No incriminating material has transpired against the petitioner to connect him with the alleged offence. The petitioner is in custody since
Patna High Court CR. MISC. No.27500 of 2021(3) dt.30-11-2021 2/2 13.11.2020. Inspite of the petitioner having remained in custody for over 1 year and the informant claiming that he can identify the accused persons on seeing them again, still the petitioner has not been put on TI Parade. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the material that has transpired in course of investigation and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Koilwar P.S. Case no. 95 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
