Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 143, 147, 149, 188, 341, 323, 325, 333, 353, 307, 427, 379, 504 and 506 of the Indian Penal Code and Sections 3 and 4 of the Bihar Medical Service Institution-cum-Person Protection Act, 2011. 3.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant with an allegation that 11 named accused persons along with 70-80 unknown persons vandalized the Community Health Center,

It is next submitted that one patient Anshu Kumari was admitted for delivery but her condition deteriorated on account of inaction of the doctors there and thereafter she was referred to G.M.C.H., Purnia for better treatment. It is next submitted that the patient had died but concealing the said fact, the dead body was referred to G.M.C.H., Purnia and when the said fact came to the notice of the accused persons, they created ruckus. It is further submitted that since petitioners are related to Anshu Kumari, as such they have been implicated in the instant case as they had taken her to the Community Health Center, Bhawanipur for her treatment.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhawanipur P.S. Case No. 184 of 2023, subject to the conditions
