JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Pipariya Police Station Case No. 13 of 2011 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
Admittedly, petitioner no. 1 and petitioner no. 3 are married Nanad and petitioner no. 2 and petitioner no. 4 are Nanadosi of the deceased and no specific overt act has been attributed against these petitioners. Although it is stated that
Patna High Court Cr.Misc. No.2856 of 2015 (2) dt.21-01-2015 2/2 petitioners were absconding from 2011 but taking note of relation of the petitioners with deceased, let petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Lakhisarai in Pipariya Police Station Case no. 13 of 2011, subject to condition as laid down under Section 438(2) of the Cr.P.C.
