The petitioner seeks pre-arrest bail in connection with Amdabad P. S. Case No. 40 of 2015 registered under Sections 379 and 440 of the Indian Penal Code and Section 40 of Bihar Minor Minerals Concession Rules, 1972.

It is contended that similarly circumstanced coaccused Abdus Salam @ Abdul Salam has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 04.01.2016 passed in Cr. Misc. No. 52070 of 2015 as contained in Annexure-3 to the present application. Regard being had to the nature of allegation as also

No.12040 of 2016 (2) dt.17-03-2016 2/2 the fact that similarly circumstanced co-accused Abdus Salam @ Abdul Salam has already been granted anticipatory bail, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. K. Chaudhary, Judicial Magistrate, 1st Class, Katihar in Amdabad P. S. Case No. 40 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
