Petitioner is languishing in judicial custody since 04.04.2017 in connection with Khagaria P.S. Case No. 211 of 2017 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code read with Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel, is that on a secret tip-off that some persons are going on a motorcycle with illegal liquor, the police apprehended the petitioner and one another co-accused, namely, Kudo Sharma with 11 litres of foreign liquor kept in a brown colour bag. It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.26001 of 2017 (2) dt.04-07-2017 2/2 petitioner that he is innocent, bears no criminal antecedent, nothing has been recovered from his conscious possession and has been falsely implicated in the aforesaid case. It has further been submitted that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence. However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Khagaria in connection with Khagaria P.S. Case No. 211 of 2017.
