Petitioner is languishing in custody since 27.02.2017 in connection with Janta Bazar P.S. Case No. 27/2017 for offences punishable under Sections 304-B/34 of the Indian Penal Code. The prosecution case, as lodged by the father of the deceased Nitu Kumari, is that his daughter was married to one Ramanand Manjhi on 01.12.2016 and all the family members of the petitioner have killed her for non-fulfillment of demand of dowry.
It has been submitted by the learned counsel for the petitioner that he is the dewar of the deceased Nitu Kumari and
Patna High Court Cr.Misc. No.26011 of 2017 (3) dt.01-08-2017 2/2 the husband is in custody. He submits that general and omnibus allegation has been levelled against the petitioner and that chargesheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail stating therein that the cause of death in the post mortem report has not been ascertained and the viscera has been preserved but the report has not yet come.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate- 1st, Saran at Chapra, in connection with Janta Bazar P.S. Case No. 27/2017. (Nilu Agrawal, J) Rajesh/- U T
