2. Petitioners apprehend arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 162, 163, 115(2), 126(2), 121(1), 121(2), 109, 132, 309(5) and 352 of the Bhartiya Nayay Sanhita, 2023.
3. On 01.08.2024, the informant received a confidential information that two criminals, namely Tinku Kumar and Deepak Kumar were planning to commit a crime using a blue Yamaha R-15 motorcycle (BR-06DM-5478) and illegal arms. On this information, a raid was conducted and during raid, S.I, Punit Kumar was surrounded, abused and
Patna High Court CR. MISC. No.13171 of 2025(2) dt.25-02-2025 2/2 assaulted by the villagers. They also attempted to strangle him and snatch his service revolver.
4. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case. There is no specific overt act against the petitioners. No incriminating article has been recovered from the possession of the petitioners. These petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the nature of accusation and gravity of offence, anticipatory bail application of the petitioner is rejected.
