Petitioner seeks bail in a case registered for the offences punishable under Sections 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
According to FIR, Ganja was, allegedly, recovered from possession of the named persons and not from the possession of this petitioner. Name of the petitioner transpired in the confessional statement of those accused persons from whose possession recovery was made. However, they have already been acquitted during trial.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.10496 of 2018 (2) dt.23-02-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Sultanganj Police Station Case No. 78 of 2013, G.R. No. 1395/2013 (SOS), subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
