Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Petitioner has got criminal antecedent under the Bihar Prohibition and Excise Act, 2016. The present allegation also relates to offence under the said Act.

Hence, in my view, this is not a fit case for grant of anticipatory bail.

Accordingly, prayer for anticipatory bail is refused in connection with Barauli P.S. Case No. 405 of 2019 pending in the Court of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gopalganj/successor Court.

Patna High Court CR. MISC. No.24794 of 2021(2) dt.03-12-2021 2/2 Petitioner is directed to surrender within a period of two weeks and pray for regular bail.
