====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 394 of the Indian Penal Code. Later on chargesheet has been submitted under Sections 395 and 397 of the Indian Penal Code.

The F.I.R. of the occurrence of robbery is against unknown. Petitioner is in custody since 26.08.2019. Submission is that the petitioner was never put on T.I.P. during the investigation of the case nor any incriminating article was recovered from his possession. Only material is confessional statement of the co-accused.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand)

Patna High Court CR. MISC. No.11857 of 2020(2) dt.28-02-2020 2/2 with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with G.R. No. 1453 of 2014 arising out of Muffasil P.S. Case No. 149 of 2014, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
