JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2017 The petitioner is in custody since 24.04.2017 in connection with Spl. Excise Case No. 19 of 2017, arising out of K.Hat P.S. Case No. 522 of 2016, registered for offences punishable under Sections 30 of the Bihar Prohibition and Excise Act, 2016.
Prosecution case is that police on secret information raided the house of co-accused of this case and found sixteen litres of foreign liquor and the said co-accused person disclosed the name of the petitioner as one of his companions in the business of selling liquor.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered either from the possession of the petitioner or from his house. As regards criminal antecedent, it has been submitted that
Patna High Court Cr.Misc. No.26178 of 2017 (5) dt.22-06-2017 2/2 in that case also nothing was recovered either from the house of the petitioner or from his possession and in that case also he was implicated falsely. Petitioner has been in custody since 24.04.2017.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case and also nothing has been recovered from the house or from the possession of the petitioner he has remained in custody for about two months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Purnea, in connection with Spl. Excise Case No. 19 of 2017, arising out of K. Hat P.S. Case No. 522 of 2016.
It is made clear if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
