JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-02-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in Manjhi P.S. Case No. 102 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Two country made pistols and five cartridges are said to have been recovered from the house of the petitioners and they were apprehended by the police.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in this case by their gotiyas having land dispute. No incriminating article has been recovered from the conscious physical possession of the

Patna High Court Cr.Misc. No.9505 of 2018 (2) dt.21-02-2018 2/2 petitioners. Petitioner no.-2 has no criminal antecedent while one case under Section 307 I.P.C. has been lodged against petitioner no.1, but he is on bail in the said case. They have been languishing in custody since 24.05.2017.

Earlier bail prayer of the petitioners was rejected by this Court vide order dated 20.07.2017 with liberty to renew their prayer for bail after six months and now the aforesaid period has lapsed.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Saran at Chapra in connection with Manjhi P.S.
