JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2017 The petitioner seeks regular bail in connection with Madhepura P.S. Case No. 734 of 2016, registered for offences punishable under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner, that he along with other accused fired on the deceased due to which he died. It has been submitted on behalf of the petitioner that only general and omnibus allegation has been levelled against the petitioner. It has further been submitted that some of the accused having similar allegations, have already been granted bail by this Court vide order dated 01.05.2017 passed in Criminal Miscellaneous No. 01.05.2017 and vide order dated 19.05.2017 passed in Criminal Miscellaneous No. 21247 of 2017 and the

Patna High Court Cr.Misc. No.26167 of 2017 (3) dt.10-07-2017 2/2 petitioner has been in judicial custody since 10.02.2017. Learned counsel for the State opposed the prayer for bail. Having heard both sides, no doubt other co-accused persons have been granted bail by this Court but they have remained in judicial custody for at least six months, as such, at this stage, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected. However, the petitioner may renew his prayer for bail after framing of charge in this case.
