Petitioner apprehends arrest in connection with Sessions Trial No. 95 of 2017 arising out of Rail Jehanabad (Taregana) P.S. Case No. 1 of 2016 registered under Sections302, 201, 304B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has been implicated in this case on suspicion. There is no allegation of demand of dowry or assault against this petitioner. There is no cogent evidence against the petitioner to connect with this case. Deceased died in railway accident. Petitioner has no criminal antecedent and is in custody since 13.04.2016.

Patna High Court Cr.Misc. No.26169 of 2017 (3) dt.29-06-2017 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner. Injuries have been found on the body of the deceased.

Considering the facts and circumstances of the case, the submissions advanced on behalf of the parties and the nature of allegations levelled, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
