JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

The accusation is of committing theft of drainage pump, cable etc., of N.T.P.C., subsequently, recovery has been made from the possession of the petitioners and they were identified by the informant.

It is submitted by learned counsel for the petitioners that certain articles were taken for making decoration on the eve of Durga Puja festival.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioners. Let the learned court below consider the regular bail of

Patna High Court Cr.Misc. No.1710 of 2015 (2) dt.15-01-2015 2/2 the petitioners if they surrender within a period of six weeks in connection with N.T.P.C. Khaira P.S. Case No. 80 of 2014 pending in the court of learned CJM, Aurangabad. Accordingly, the application is disposed of.
